These Terms of Use supplement the White Risk general ToS and Privacy.
By submitting an observation, users confirm that they have read, understood, and accepted these Terms of Use.
Terms of Use “Submit your observations”
Location-Based Observations
Users of the White Risk app can report location-based observations on the current avalanche situation (“Submit Your Own Observation”).
The location-based observations (“Observation Content”) consist of:
Location, date, and observation characteristics, e.g., avalanche type, snowdrift thickness, number of whumpf sounds (“Observation”);
Additional information such as media (photos, videos), comments, and/or damage data that serve to illustrate the observation (“Supplementary Information”).
Prohibited Content
By submitting an observation, users confirm that the Observation Content contains no personal data (in particular, photos of identifiable persons, vehicle license plates, names, addresses, etc.) and no illegal or inappropriate content (in particular, pornographic, defamatory, racist, or offensive material, etc.) (“Prohibited Content”).
Copyright and Usage Rights
Users confirm that they hold the sole copyright and usage rights to the Supplementary Information.
When submitting Observation Content, users can choose between the following two options:
“Share entire observation content publicly”: Users grant the WSL Institute for Snow and Avalanche Research (SLF) all transferable rights to the entire Observation Content (Observation and Supplementary Information), without limitation in time or place. This grant of rights includes, in particular, the right for SLF to use, reproduce, publish, modify, and distribute the Observation Content in any form, permanently and for the fulfillment of its legal duties.
“Supplementary information for internal SLF use only”: Users grant SLF all transferable rights to the entire Supplementary Information for internal use, without limitation in time. This grant of rights includes, in particular, the right for SLF to use the Supplementary Information for avalanche warning, research purposes, and further development of the White Risk app in fulfillment of its legal duties.
Contact Details
Users may optionally provide contact details. In this case, they will be named as the author of the Supplementary Information upon publication. If no contact details are provided, users waive the exercise of their moral rights in relation to the Supplementary Information. In such cases, the publication will include the following source reference: “Anonymous observation, White Risk app.”
Violations
In the event of violations of these Terms of Use, SLF reserves the right to permanently disable the “Submit your observations” functionality.
